Article 1: In accordance with the relevant provisions of the People's Republic of China, these Measures are formulated to safeguard the implementation of the marriage system of freedom of marriage, monogamy, and gender equality, protect the legitimate rights and interests of marriage parties, and prevent violations of the Marriage Law.
Article 2: Both men and women who voluntarily marry, divorce or remarry must register their marriage in accordance with these Measures.
The legitimate rights and interests of marriage parties who perform registration in accordance with the law are protected by law.
Article 3: The authorities responsible for marriage registration are township, ethnic township, and town people's governments in rural areas, and street offices or district people's governments or city people's governments without districts in urban areas.
Article 4: If both parties voluntarily marry, they must personally apply to the marriage registration authority in the place where one party's household registration is located. When applying, the applicant shall present his/her resident identity card or registered residence certificate, and a certificate issued by his/her unit or village committee (neighborhood committee) stating his/her date of birth and marital status (unmarried, divorced, widowed). When applying for remarriage for those who have been divorced, they should also provide the necessary documents.
Article 5: After examination and understanding, the marriage registration authority shall approve the registration of those who comply with the provisions of the Marriage Law and these Measures, and issue a notice to them; Those who do not comply with the provisions of the Marriage Law and these Measures shall not be registered, and the parties shall be educated on the Marriage Law.
If the parties applying for marriage are unable to obtain the required proof due to interference from their employer or others, and the marriage registration authority confirms that they indeed comply with the provisions of the Marriage Law and these Measures, they should also be allowed to register and issued a Marriage Certificate.
Article 6: If both or one of the parties applying for marriage falls under any of the following circumstances, marriage shall be prohibited and registration shall not be granted:
(1) Those who have not reached the legal age for marriage;
(2) Involuntary;
(3) Those who already have a spouse;
(4) Belonging to direct blood relatives and collateral blood relatives within three generations;
(5) Those who suffer from untreated leprosy or sexually transmitted diseases.
Article 7: If both parties voluntarily divorce and reach an agreement on property disposal, both parties must personally apply for divorce registration at the marriage registration authority in the place where one party's household registration is located. At the time of application, a resident identity card or registered residence certificate and Marriage Certificate shall be presented. The marriage registration authority has confirmed that the situation is true and should approve the registration, issue a divorce certificate, and revoke the marriage certificate.
If one party requests divorce, or if both parties request divorce but fail to reach an agreement on child custody and property management, the marriage registration authority will not accept it.
Article 8: If both parties voluntarily restore their marital relationship after divorce, they must personally apply for remarriage registration at the marriage registration authority in the place where one party's household registration is located. The marriage registration authority shall handle the registration according to the marriage registration procedure, issue a "marriage certificate", and revoke the "divorce certificate".
Article 9: Both men and women applying for marriage, divorce, or remarriage registration shall provide practical information that the marriage registration authority must be aware of.
If the marriage registration authority discovers that the parties to the marriage have violated the Marriage Law, or have falsified or obtained the Marriage Certificate during registration, the marriage shall be declared invalid, the obtained Marriage Certificate shall be revoked, and the responsible party shall be criticized and educated.
