Coercive marriage refers to the act of causing harm or direct harm to others through illegal threats, forcing them to marry due to fear or harm. This behavior seriously violates an individual's right to marital freedom and goes against the principle of marital autonomy.
According to Article 1052 of the Civil Code of the People's Republic of China, if a marriage is forced, the coerced party may request the revocation of the marriage from the people's court.
At the same time, the legal provision also clearly stipulates the deadline for the coerced party to request the revocation of the marriage, which should be submitted within one year from the date of termination of the coercive act.
If the coerced party illegally restricts their personal freedom, they shall submit a request to dissolve the marriage within one year from the date of restoring their personal freedom.
II
According to the Civil Code of the People's Republic of China, the conditions for revoking a marriage mainly include two aspects:
1. Marriage must be established through coercion;
The coerced party must submit a request to dissolve the marriage within the statutory deadline.
Both of these conditions are indispensable, and only when both conditions are met simultaneously can the marriage be successfully dissolved.
III
1. A coerced marriage is a revocable marriage, not an invalid marriage. This means that the marriage is valid and legally binding until revoked.
Once the coerced party submits a request to dissolve the marriage within the statutory time limit and receives support from the people's court, the marriage will be deemed non-existent from the beginning, and the marriage will be deemed invalid from the beginning.
3. It should be noted that only marriages under specific circumstances such as bigamy, prohibited family relationships, and under legal marriage age are considered invalid marriages, and marriages that have been coerced are not included in the above scope.
In short, coerced marriage is a serious violation of an individual's right to freedom of marriage, and the coerced party can request the revocation of the marriage through legal means. Before revocation, the coerced marriage has legal effect, but once revoked successfully, the marriage will be invalid from the beginning.
