  According to Article 8 of the revised Marriage Law, which was promulgated and implemented on April 28, 2001, "Both men and women who are required to get married must personally go to the marriage registration office to register their marriage. Those who meet the requirements of this law will be registered, issued a marriage certificate, and the marriage certificate will be obtained, thus establishing the marital relationship. If the marriage registration has not been completed, it should be completed."   1、 For those who apply for marriage registration, the validity of the marriage relationship shall be calculated from the time when both parties meet the substantive requirements for marriage stipulated in the Marriage Law;
  2、 Before the promulgation and implementation of the Marriage Registration Management Regulations by the Ministry of Civil Affairs on February 1, 1994, if both parties have already met the substantive requirements of marriage but have not registered, they shall be treated as a de facto marriage; After the promulgation and implementation of the Marriage Registration Management Regulations by the Ministry of Civil Affairs on February 1, 1994, if both parties meet the substantive requirements for marriage, the people's court shall notify them to reapply for marriage registration. If they fail to reapply for marriage registration, they shall be treated as terminating their cohabitation relationship;
  Applying for marriage registration has standardized the legally recognized factual marriage and cohabitation phenomena between men and women who meet the substantive requirements of marriage. For historical factual marriages, as long as they meet the factual marriage requirements of the Supreme People's Court's relevant judicial interpretations, they are still considered factual marriages.
