Mr. And Mrs. Zhang, both in their eighties, recently filed a lawsuit against their three sons in court, demanding that they fulfill their duty of support. The third son argued in court that his parents had an uneven division of the family property and thus had no right to demand alimony. The case was heard by the Wengyuan Court, and it was ultimately ruled that the third son must pay alimony every month.
The plaintiff, Mr. And Mrs. Zhang, have a total of five sons and one daughter, namely Zhang Jia, Zhang Yi, Zhang Bing, Zhang Ding, Zhang Wu and Zhang Ji, all of whom have established their own families and careers. During the court hearing, Grandpa Zhang claimed that his second son, Zhang Yi, is currently unknown. Only his fourth son, Zhang Ding, and his eldest daughter, Zhang Ji, are supporting their parents. The other three sons are legally obligated to fulfill their duty of support. All three argued in their defense that their parents' division of the family property was uneven, and they refused to continue fulfilling their duty of support on the grounds of heavy family burdens.
The court held that it is a legal obligation for children to support their parents, and this obligation cannot be mitigated or exempted due to issues such as whether the distribution of the parents' property is reasonable. Ultimately, the court ruled that the six children should share the monthly support standard of 900 yuan for the two elders.
