Marriage that has been held without a license is not protected by law. China's previous Marriage Law no longer recognizes de facto marriages, and only marriage registration that has been processed through legal procedures is protected by law.
If only a wedding is held without marriage registration, it can only constitute a cohabitation relationship and is not protected by law. When it does not constitute a marital relationship and conflicts arise, there is even less talk of divorce.
Legitimate marriage is a civil legal act in which both parties go to the local civil affairs bureau to register their marriage and determine their marital relationship in accordance with legal provisions. A legal marriage must meet the following conditions:
1. The legal age for marriage. Men must not be earlier than 22 years old, and women must not be earlier than 20 years old.
2. There shall be no circumstances where marriage is prohibited by law. People who are close relatives or suffer from diseases that medically should not be married.
3. It must be a marriage between a man and a woman of the opposite sex. China's Marriage Law does not allow same-sex marriage and does not recognize same-sex marriage relationships.
4. Both husband and wife must voluntarily marry.
5. Neither party has a spouse.
Documents submitted for marriage registration:
1. My permanent household registration book and resident ID card.
2. I hereby declare that I have no spouse and no direct blood relationship or collateral blood relationship within three generations with the other party.
3. The parties involved submit three 2-inch recent half body color photos without a crown.
4. When divorced parties apply for marriage registration, in addition to providing the three aforementioned documents, they should also provide valid documents (divorce certificate, certificate of termination of marital relationship, divorce mediation agreement of the people's court, legally effective divorce judgment).
