Do I need a divorce certificate for my second marriage

A divorce certificate is required for a second marriage. Law firms remind that according to national laws, parties who register for marriage should submit their own ID cards, household registration books, valid passports, as well as signed statements from both parties stating that they have no direct blood relatives or collateral blood relatives within three generations, and no spouse. Article 4 of the Marriage Registration Regulations
Mainland residents who get married should jointly go to the marriage registration authority in the place where one party's permanent household registration is located to handle the marriage registration. If a Chinese citizen marries a foreigner in the mainland of China, or a mainland resident marries a Hong Kong resident, a Macao resident, a Taiwan resident, or an overseas Chinese in the mainland of China, both men and women shall jointly go to the marriage registration office in the place where the mainland resident's permanent residence is located to register their marriage.

There is no legal requirement for marriage checkups to be conducted during the registration of a second marriage. Marriage checkups are voluntary. Mainland residents who apply for marriage registration shall provide the following documents and proof materials:

According to Article 1049 of the Civil Code of the People's Republic of China, both the man and the woman who request marriage shall personally apply for marriage registration at the marriage registration authority. Those who comply with the provisions of this law shall be registered and issued a marriage certificate. Completing marriage registration establishes the marital relationship.
