Shanghai Marriage Registration Management Measures (Revised)

CHAPTER I GENERAL PROVISIONS
Article 1 (Purpose and Basis)

Article 2 (Scope of Application)
Registration for marriage, divorce, or remarriage between residents of this city or between residents of this city and residents of other provinces and cities within the scope of this city is applicable

Article 3 (Protection of the Legitimate Rights and Interests of the Parties)

Article 4 (Certification Responsibility)
Each government agency, organization, enterprise, institution, resident committee, and village committee shall apply for marriage for their own unit or local area

Chapter 2 Marriage Registration Management Authorities and Registration Administrators
Article 5 (Registration Administration Authority)
The Shanghai Civil Affairs Bureau (hereinafter referred to as the Municipal Civil Affairs Bureau) is responsible for the management of marriage registration throughout the city, and the civil affairs bureaus of each district and county or
The township and town governments are responsible for the management of marriage registration within their respective administrative regions.

Article 6 (Responsibilities of Registration Management Authorities)
The responsibilities of the marriage registration management authority are:

Article 7 (Marriage Registration Administrator)
The marriage registration management authority shall appoint a full-time marriage registration administrator.
Article 8 (Qualifications of Marriage Registration Administrators)
Marriage registration administrators shall receive business training from the Municipal Civil Affairs Bureau. Those who pass the assessment shall be issued marriage registration management by the Municipal Civil Affairs Bureau
Employee certificate.
Individuals who have not obtained the certificate of marriage registration administrator are not allowed to undertake marriage registration.
Article 9 (Job Requirements)
Job requirements for marriage registration administrators:
（1） Strictly implement relevant laws and regulations such as the Marriage Law and the Regulations on the Administration of Marriage Registration;
（2） To enforce the law impartially, and not to bend the law for personal gain or abuse power for personal gain;
（3） The parties shall not be required to provide any other documents or certificates other than those stipulated in these Measures;
（4） Not allowed to handle marriage registration for oneself or close relatives;

Chapter 3
Article 10 (Application for Marriage Registration)
If the parties request to register their marriage in this city, both parties must go to the marriage registration management machine in the place where one party's permanent household registration is located in this city at the same time

Article 11: When applying for marriage registration, one should present identification documents
When applying for marriage registration, the parties must provide the following documents and certificates:
（1） Household registration certificate;
（2） Resident ID card;
（3） Marriage status certificate issued by the residential (village) committee of the unit or household registration location;

Article 12 (Application for Marriage Registration of Active Duty Soldiers)

Article 13 (Application for Marriage Registration of Individuals Leaving the Country for Private Purposes)
If one of the parties applying for marriage registration is a person who has left the country for personal reasons and requests to register their marriage in this city, they shall reside permanently in this city
The marriage registration management authority in the place of household registration shall handle the application for marriage registration procedures; Both parties applying for marriage registration are privately involved
Individuals who wish to register their marriage in this city should go to the marriage registration management authority in the place where one party's original household registration is located to apply for settlement

Article 14 (Application for Marriage Registration of Overseas Personnel on Official Business)
