According to the Beijing Civil Affairs Bureau, the "Beijing Work Standards for Reissuing Marriage Registration Certificates (Trial)" stipulate that reissuing marriage registration certificates will not be processed under three circumstances.
It is reported that in cases where a marriage certificate or divorce certificate is lost, damaged, or its content does not match the identity document (name, document number, etc.) held, the parties can apply to the marriage registration authority for a replacement.
According to regulations, the situations where the parties apply for a replacement marriage registration certificate and are not allowed to do so include:
One is when the parties apply for a replacement marriage registration certificate, and the declared registration date shows that the files are kept intact. There is no marriage registration file for the parties and they are unable to provide the marriage registration certificate;
Secondly, if the parties involved have not reached the legal age of marriage when registering for marriage and have not yet reached the legal age of marriage when applying for a replacement;
Thirdly, when applying for a replacement divorce certificate, if the parties' divorce registration files are not available or difficult to verify.
After confirming that the marriage registration file is lost or difficult to verify, the parties shall submit a certificate of file loss or difficult to verify issued by the file storage department. If it is indeed impossible to provide the above proof, after verification by the marriage registration authority, the parties shall provide a written explanation of the investigation situation. The parties involved should also provide proof of marital status. The marriage registration certificate, the record of the marital relationship in the household registration book, the marriage status certificate issued by the public security organ, the unit where the archives are located, the village (neighborhood) committee, two close relatives, or the notarized certificate issued by the notary office can serve as proof of the marital status of the parties involved. If a close relative provides proof of marital status, they should submit proof of kinship and their own identification documents. If these certificates cannot be issued, a marriage registration certificate cannot be reissued. It is understood that the custody of marriage registration archives is uniformly managed by the Civil Affairs Bureau and regularly transferred to the archives of the district or county where the parties are located.
In the new regulations, the handling procedures have also been standardized and further facilitated for citizens to handle. For example, if the marriage registration certificate of a party who applied for marriage registration in this city after January 1, 2005 is lost or damaged, the marriage registration authority can query through the marriage registration system. If the information recorded in the electronic system, such as the party's name, date of birth, and ID number, is consistent with the person's ID card, the examination and processing form in the system can be printed as proof of file retrieval. The parties involved may be exempted from accessing the archives.
The marriage registration authority will not accept applications that do not meet the conditions for reissuance. The staff will inform the parties of the reasons for the rejection and provide them with relevant legal consultation services.
