Notes on applying for a marriage certificate for widowed remarriage

  Attention: Both parties, including their ID card, household registration book, and proof of their spouse's death, should apply for marriage registration at the marriage registration office in the place where one party's household registration is located.

  Both the man and woman who request marriage should personally apply for marriage registration at the marriage registration office. Those who comply with the provisions of this law shall be registered and issued a marriage certificate. Completing marriage registration establishes the marital relationship. Those who have not registered their marriage should apply for registration again.

  1. Application: Obtain the original ID cards (temporary ID cards) of both the male and female parties, the original household registration book (proof of household registration/collective household registration page), and three 2-inch recent bareheaded photos. For those who have been divorced, please bring your divorce certificate or judgment.
  2. Acceptance: Go to the marriage registration office hall of the civil affairs department where one party's household registration is located, and both parties will personally attend to submit the above procedures.
  3. Review: Check the household registration book and ID card to see if the ID card has expired and if the photo matches the person in question.
  4. Registration: Ask if both parties are willing to pay a registration fee of 9 yuan. Both parties shall write a declaration, sign and fingerprint it, register the personnel number, register and print the marriage certificate, and fill out the marriage registration review and processing form.
  5. Issuance: After completing the registration procedures, the relevant registration procedures will be archived, and the marriage certificate will be issued to both parties on the spot, officially declaring the marriage relationship. The law will confirm the marriage relationship between the two parties and bring the divorce certificate.

  Children who remarry have the right to inherit. Children are the first in line heirs of the deceased. The inheritance rights of stepchildren in a second marriage are determined based on whether they have formed a support relationship with their stepparents. If both parties have formed a support relationship, when the stepparents pass away, the stepchildren are the first in line heirs and enjoy the inheritance rights.
