What conditions must be met to register for marriage?
There are two conditions for marriage: one is the mandatory conditions, and the other is the prohibited conditions for marriage.
The necessary conditions are:
Marriage must be based on the complete willingness of both the man and the woman. It is not allowed for one party to force the other or for any third party to interfere.
2. The minimum age for marriage for men shall not be earlier than 22 years old and for women no earlier than 20 years old.
3. It conforms to the basic principles of monogamy.
The conditions prohibiting marriage are:
1. Direct blood relatives and collateral blood relatives within three generations;
2. Suffering from a disease that is considered by medical science as unsuitable for marriage.
Ii. Where to register for marriage?
Where a Chinese citizen marries a foreigner in the Chinese mainland, or a mainland resident marries a resident of Hong Kong, Macao, Taiwan or overseas Chinese in the Chinese mainland, both the man and the woman shall jointly go to the marriage registration authority at the place where the mainland resident has a permanent residence to handle the marriage registration. The authority for handling marriage registration is the civil affairs department of the provincial, autonomous regional or municipal people's government, or the authority determined by the civil affairs department of the provincial, autonomous regional or municipal people's government (generally the civil affairs department of the county-level people's government).
Iii. What materials are needed for marriage registration?
(1) Mainland residents
1. My household register and ID card.
2. A signed statement by myself stating that I have no spouse and no direct blood relationship or collateral blood relationship within three generations with the other party.
(2) Hong Kong residents
1. Mainland Travel Permit for Hong Kong and Macao Residents or Home Return Permit for Hong Kong and Macao Compatriots.
2. Hong Kong Resident Identity Card.
3. A statement notarized by a notary public in Hong Kong, stating that the individual is unmarried and has no direct blood relationship or collateral blood relationship within three generations with the other party.
(3) Residents of Macao
1. Mainland Travel Permit for Hong Kong and Macao Residents or Home Return Permit for Hong Kong and Macao Compatriots.
2. Macao Resident Identity Card.
3. A statement notarized by a notary public in Macao stating that the individual is unmarried and has no direct blood relationship or collateral blood relationship within three generations with the other party.
(4) Residents of Taiwan
Mainland Travel Permit for Taiwan Residents or other valid travel documents.
2. A valid identification document of my residence in Taiwan region.
3. A statement notarized by a notary public in Taiwan stating that the individual is unmarried and has no direct blood relationship or collateral blood relationship within three generations with the other party.
(V) Overseas personnel and overseas Chinese
1. My valid passport.
2. A certificate issued by a notary public or competent authority in the country of residence and authenticated by the embassy (consulate) of the People's Republic of China in that country, certifying that the individual is unmarried and has no direct blood relationship or collateral blood relationship within three generations with the other party, Or a certificate issued by the embassy (consulate) of the People's Republic of China in that country, certifying that the individual is unmarried and has no direct blood relationship or collateral blood relationship within three generations with the other party.
Certificates issued by countries that have no diplomatic relations with China shall be authenticated by the embassies (consulates) of the third countries that have diplomatic relations with both that country and China in that country and the Chinese embassies (consulates) in the third countries, or by the embassies (consulates) of the third countries in China.
(6) Foreigners
1. My valid passport or other valid international travel document.
2. A certificate issued by a notary office or competent authority of the country where the applicant is located, which is authenticated by the embassy (consulate) of the People's Republic of China in that country or by the embassy (consulate) of that country in China, certifying that the applicant is unmarried; Or a certificate issued by the embassy or consulate of the country of residence in China stating that the individual is unmarried.
Certificates issued by countries that have no diplomatic relations with China shall be authenticated by the embassies (consulates) of the third countries that have diplomatic relations with both that country and China in that country and the Chinese embassies (consulates) in the third countries, or by the embassies (consulates) of the third countries in China.
A declaration or certificate of being unmarried from Hong Kong, Macao, Taiwan region and abroad is valid for six months from the date of issuance.
Iv. Procedures for Marriage Registration
Both the man and the woman who wish to register their marriage shall, with the required documents, jointly go to the marriage registration authority of the district or county-level municipal civil affairs bureau (or the town government) where one of them has a permanent residence to apply.
2. Both parties shall personally go to the marriage registration authority to submit an application and each fill out a declaration of application for marriage registration.
3. Both parties must personally sign or affix their fingerprints in the declarant column of the application for marriage registration in the presence of the marriage registrar.
4. The marriage registration authority shall review the certificates and statements submitted by both parties. If they meet the conditions for marriage registration, the registration shall be granted.
V. Time Limit and Fee Standards for Marriage Registration
1. Registration time limit: If all the documents and materials are complete, registration will be made on the spot and a marriage certificate will be issued.
2. Fee standards: 9 yuan per couple for domestic marriage registration plus other related fees.
