In February 2003, Liao Dazhi filed a petition against his sister Liao Xiaoling in the dock of the Dujiangyan Irrigation Project City Court, asking the court to declare the original transfer agreement signed by the original defendant invalid and order the defendant to return the house to the plaintiff. Liao Dazhi claimed in the lawsuit that there were invalid factors in the transfer agreement signed between the plaintiff and the defendant. Firstly, the transfer agreement was actually a house gift contract and should be revoked according to the invalid contract; The second is that the transfer of the obligation to support violates legal provisions, and the content of the agreement is illegal.
Dujiangyan Irrigation Project City Court immediately accepted this unprecedented case of transfer of maintenance obligations.
Since being sued by her brother, Liao Xiaoling's heart has been filled with pain and conflict. She knew that her brother's purpose for returning to the property was not to support his mother, but for his own personal gain!
In October and December 2003, the court held two hearings to hear this case. During the trial, the plaintiff Liao Dazhi and the defendant Liao Xiaoling siblings engaged in a tit for tat argument in court regarding the validity of the agreement to transfer their maintenance obligations. After trial, the court unanimously agreed that the plaintiff Liao Dazhi did not question the authenticity of the agreement in the civil complaint, and that this agreement can indeed ensure that the elderly have a place to rely on in their later years. Therefore, the court ultimately determined that the agreement signed by the plaintiff and defendant should be a valid agreement. According to the agreement, the plaintiff and defendant transferred the responsibility of providing for the elderly, which refers to the material obligation of support. Material support obligations can be fulfilled by others and will not affect the rights and interests of the elderly.
Subsequently, the plaintiff Liao Dazhi submitted to the court that the house was jointly owned by husband and wife, and he transferred the house to his sister without his wife's consent. Therefore, this transfer should be considered invalid.
The court also did not support the plaintiff's claim. The judge believes that although the plaintiff Liao Dazhi's wife was unaware of the situation when the agreement was signed, after Liao Dazhi transferred the house to the defendant, the couple no longer fulfilled their obligation to support their mother. Based on this, the court subsequently presented the investigation transcript of the mother of the plaintiff and defendant, Xu Shaofang. The investigation record confirms that Liao Dazhi did not fulfill his obligation to support his mother after transferring the house to the defendant. Therefore, the court believes that Liao Dazhi and his wife jointly recognized the transfer behavior at that time.
On January 20, 2004, the Dujiangyan Irrigation Project City Court pronounced the first case of assignment of maintenance obligations in China.
