Couples who meet one of the following conditions may request to have another child:
(1) One party has not given birth to any children before marriage, while the other party has given birth to one child before marriage, and both parties have one child together after marriage;
(2) Where both parties have a total of two or more children before marriage and have no common children;
(3) Where neither party had any children before marriage and they have two children together after marriage, and one of the children has been identified by a district, county or municipal medical appraisal institution for disabled children as having a non-hereditary disability and is unable to grow up to be a normal labor force.
In addition to the conditions stipulated in the preceding paragraph, the conditions for having another child due to special circumstances shall be separately prescribed by the municipal people's government.
Those who meet any of the following three conditions can be recognized as "only children" :
I am the only child born and raised by my parents. That is: no half-siblings with the same father or mother, no half-siblings with the same mother, no half-siblings with the same father or half-mother, and no adopted brothers or sisters.
(2) I am the only child lawfully adopted by my parents. That is: being lawfully adopted by adoptive parents and being their only child.
(3) The parents have lawfully given birth to (lawfully adopted) two or more children, and all other children have died and no children have been born. The individual is the only remaining child of the parents. That is: I am the only remaining child of my parents, and no descendants have been born to my other deceased siblings.
Couples who meet the application requirements may apply for a second child at the following family planning work institutions.
If only one of the couple is a resident of Shanghai, they should apply to the family planning office of the town government (sub-district office) where their household registration is located in Shanghai for another child.
(2) Both the husband and wife are registered residents of Shanghai. Among them, ① If both parties have agricultural household registration, they should apply to the family planning office of the town government (sub-district office) where the man's household registration is located for another child. For those with other household registration natures, an application for another child should be made to the family planning office of the town government (sub-district office) where the woman's household registration is located.
