2022 Shanghai Marriage Leave Regulations: Marriage Leave of 3 Days+Late Marriage Leave of 7 Days=10 Days
According to Part 5 of the Civil Code on Marriage and Family and the Family Planning Regulations, those who marry at the age of 20 for women and 22 for men are entitled to 3 days of marriage leave.
Article 33 of the Shanghai Population and Family Planning Regulations stipulates that citizens who marry late shall enjoy an additional seven days of late marriage leave in addition to the marriage leave provided by the state. Salary and benefits during marriage leave
According to the "Shanghai Enterprise Wage Payment Method", wages during marriage leave should be determined based on the following principles:
(1) If there is an agreement in the labor contract, the wage standard shall be determined according to the corresponding position (position) of the worker as stipulated in the labor contract. If the standard determined in the collective contract (wage collective agreement) is higher than the standard stipulated in the labor contract, it shall be determined according to the standard stipulated in the collective contract (wage collective agreement).
(2) If there is no agreement in the labor contract or collective agreement, it can be determined through collective wage negotiation between the employer and the employee representative, and the negotiation result should be signed into a collective wage agreement.
