  A remarriage agreement is just a general agreement. As long as it does not violate the mandatory provisions of the law, it is valid and does not require notarization. However, signing a remarriage agreement merely indicates that both parties have the intention to remarry. Signing a remarriage agreement does not guarantee a legal marital relationship. To become a legal couple, one still needs to register for remarriage at the marriage registration authority.
  1. They were once married and have divorced in accordance with the legal procedures;
  2. Not remarried after divorce;
  3. Voluntarily restore the marital relationship.
  In addition to the above three conditions, the Civil Code also stipulates that no unit or individual may set any form of additional conditions for remarriage registration.
  The procedures for applying for remarriage are similar to those for applying for marriage. The procedures are as follows:
  (1) Application. Both the man and the woman who wish to register their marriage shall jointly go to the marriage registration authority of the district or county-level civil affairs bureau where one of them has a permanent residence with the required documents to apply.
  (2) Fill in the declaration form. Both parties shall personally go to the marriage registration authority to submit an application and each fill out a "Declaration of Application for Remarriage Registration".
  (3) Signature. Both parties must personally sign or affix their fingerprints in the "Declarant" column of the "Application for Remarriage Registration Declaration" in the presence of the marriage registrar.
  (4) Review and registration. The marriage registration authority examines the certificates and statements submitted by both parties. If they meet the conditions for remarriage registration, the registration will be granted.
  (V) Remarriage registration certificate. After the remarriage registration procedures are completed, the original divorce certificate or court judgment (or mediation statement) must be revoked and a remarriage registration certificate issued for it to have legal effect.

  Legal basis
  Article 1083 of the Civil Code of the People's Republic of China stipulates that after divorce, if both the man and the woman voluntarily restore their marital relationship, they must register for remarriage at the marriage registration authority.
  After remarriage, if a prenuptial property agreement is signed between the couple (if conditions permit), the agreement can be notarized to ensure that there will be no disputes over the ownership of the two houses.
  The above is what the editor of Legal Express has collected for you about whether a 2022 remarriage agreement needs to be notarized. A remarriage agreement is just a general agreement.
